VALLEY DAIRY HAND
ON WOUNDING CHARGE
A JURY in the Criminal Court at Hobart yesterday acquitted
Roland George Hyatt (39), dairy hand, of Lenah Valley, of
a charge of having, on September 12, wounded John Patrick
Breen with intent to cause grievous bodily harm.
The jury also acquitted.Hyatt
of having unlawfully, wounded
Breen.
Hyatt had pleaded not guilty.
The. hearing was before the
Acting Chief Justice (.Mr. Jus-
tice Green).

heard on Friday, and yesterday
the Crown called further evi-
dence.

Henry, of Lenah Valley, said
Hyatt and. Breen were his sons
in-law.
On September 12, he was cut-
ting wood and Hyatt was on the
hill behind the house cutting
wood. He saw Breen approach-
ing and called to Hyatt.
Hyatt told Breen to go awayi
because he had caused enough
trouble. He told him atoout a
dozen times, McHenry said.
McHenry said Breen had his
hand inside his coat and said
he had something there that
would fix Hyatt "this time."
McHenry said Hyatt backed
away from Breen and asked
him to set the rifle.
He gave it to Hyatt who fired
a bullet to one side of Breen's
feet. Hyatt again told Breen
to go away and fired a second
shot.
. McHe'nry said he saw the sec-
ond bullet land about two feet
in front of. Breen's 'feet. ?
Fell Over
Breen said, he was shot and
fell over. He took a fork and
what appeared to be a bottle of
brandy from his pocket, then
got up and walked a few yards
before falling beside the road.
Cross-examined by Mr.. Dris-
coll, McHenry said Breen had
attacked Hyatt on several occa-
sions-once with pieces of glass,
once with a sheath knife, and
another time Breen had tried to
break a bottle while arguing
with Hyatt.
Giving evidence, Hyatt said
Breen had attempted to attack
him before the- shooting inci-
dent.
On September 12 he had
argued with Breen and had ask-
ed his father-in-law to ¿get hi«!
rifle because he wanted to fire
a shot and frighten Breen.
Hyatt said he had fired the
first shot and Breen had called
that he had shot too low. Breen
had come towards him and he
had fired a second shot.
Hyatt said he had fired both
shots without aiming directly
at Breen and he had no inten-
tion of hitting him. He could
not recall the second bullet
kicking up dust, Hyatt said.
Hyatt said he had sent for
!the police himself and had giv-
en the rifle to McHenry after
Breen had been shot.
Cross-examined by Mr. Hut-
chins, Hyatt said he had no
idea what Breen had in his
pocket., Breen was drunk
¡enough to make him mad, "but
not that drunk."
Mr. Hutchins: How many..bul
lets did you have?-Two.
Mr. Hutchins: You know the
rifle mechanism, did you have
to reload 'I-Yes.
Hyatt said he had fired the
second shot without the inten-
tion of hitting Breen.

8. | Henry Louis MCKENRY was born 1859 (son of John MCKENRY and Matilda GILMORE); died 1943. Other Events:
- Biography Notes: On April 24, 1912 at 'Innisvale', the home of her father, Esther May McDonald was married to John (Jack) Thomas McKenry by the Horsham Presbyterian minister, the Reverend Thomas Gray. The attendants were Joseph Henry Gordon Stevenson McKenry, brother of the groom, and Beatrice Louisa McDonald, sister of the bride.
Jack was the son of Henry Louis and Janet McKenry, nee Poole, and was born in 1888 in Adelaide, South Australia.
The McKenry family had migrated to Australia from Ireland but was of Scottish origin. The McKenrys are members of the Henderson clan and also claim kinship with the Morrison and Macdonald clans.
In 1857 Jack's mother (or grandmother?), Matilda McKenry, had sailed from Liverpool in the 'Jessie Munn' with four sons, John, James, Joseph and Samuel, to join her husband John in Australia. The family disembarked at Geelong, Victoria, and journeyed to Bacchus Marsh where John was employed.
Four more children were born in Australia: Henry, Matilda, Sarah and Annie.
Henry went to Adelaide as a young man where he met and married Janet Poole.
After the birth of their first two children, John Thomas and Jessie Matilda, they returned to Victoria and bought a property at Toolondo, a district adjoining Nurrabiel and Carchap.
The McKenry family also operated a sawmill at Toolondo, and when Esther?s aunt Flora and her husband Joseph McDonald moved from Nurrabiel to the Mockinya district in 1906 the timber for their new home was sawn at McKenry's mill.
